INFORMATION COLLECTION
RealUp is the sole owner of the information collected on our website. RealUp collects information at several different points on our website. Contact information such as name, email and address is collected for the purpose of making online purchases of our products and include all of the necessary data needed for describing products and the customer information for delivering our products. The reason we use this information is to complete the e-commerce transactions, contact customers by email or regular mail and to maintain and secure our site. We retain this information for an indeterminate period of time.

We collect user information from several areas of the site including the membership registration, property listings, property searches, customer communications, professional profiles, online forum, email forms, contests, promotions and surveys. RealUp collects financial information, including credit card number and expiration date in order to process billing payment and credit card authorization. User search activity is collected and analyzed and may be utilized by RealUp in the aggregate. RealUp may collect individual user search activity for statistical, archival, and business purposes. RealUp may track the IP address of a user's computer or place a "cookie" in the browser files of a user's computer. IP address and cookie log data is analyzed to better understand traffic flows and user preferences.

USE OF INFORMATION
Information collected from users helps us better understand customer needs in order to improve our products and services. Email addresses are used to communicate with members through newsletters, press releases, promotional emails, partner emails and for account administration. Users may request at any time to be deleted from newsletter, promotional email and partner email lists. For further information, see OPT-OUT section below. Personal information may be used to contact users for the purpose of research, development, marketing, or customer service.

Financial information is used to bill users for products and services purchased. Within RealUp, only accounting managers have access to the credit card account information. This information is not shared with anyone outside of RealUp.

SHARING INFORMATION
Though we make every effort to preserve user privacy, we may disclose personal information when required by law or requested by law enforcement and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website. Personally identifiable information is not shared with third-parties for any promotional purposes. Aggregate information is not shared with any third-parties.

RealUp shares member information in property listings and professional directory. When a member enters a sale or lease listing user contact information is also entered. Users searching RealUp can view contact information including name, email and phone number, when they view a property listing or professional profile. RealUp allows users to share contact information with one another with the contact feature. Unless required by law RealUp does not share individual user search activity information and such activity information remains private to the individual user. Professional profile users agree to share their contact information and allow all RealUp users to view their contact information via the RealUp professional directory. RealUp users may opt out of the professional directory service at anytime by providing notice to RealUp. For further information, see OPT-OUT section below.

RealUp shares information with its partners for the purpose of providing related services in which we deem our users have interest, including lending quotes and recent sales data. Billing information, including credit card number, expiration date and dollar amount, used to make online purchases of products or services is shared with our credit card processing partner in order to authorize charges to the credit card. RealUp also uses third-party providers to perform customer mailings, however this information is confidential and is not used by the provider for any other purpose.

RealUp does not rent or lease user information to any third-party, except as disclosed. Our goal is to only contact individuals who we believe may have a legitimate business interest in RealUp based on their membership or participation in other organizations or sites, and who have indicated a willingness to be contacted for this purpose.

In the event RealUp merges with a third-party, or in the event all or substantially all of RealUp's assets are acquired by a third-party, customer information, including personally identifiable information, will be shared and/or transferred to such third-party. The data may only be used or shared by such third-parties for the purpose for which the information was originally collected.

DATA SECURITY
RealUp has physical security in our facilities to protect against the loss, misuse, or alteration of information. Our company uses secure encryption technology for confidential and e-commerce data transmitted on our site. Personal information collected by RealUp is treated with the utmost respect and security. RealUp takes every feasible precaution to secure personal information within both its computers and its physical premises.

The security of your private data is very important to RealUp. When you enter sensitive information, such as a credit card number, we encrypt that information using secure socket layer (SSL) technology. We follow industry standards and best practices to protect the personal information submitted to RealUp. However, no method of transmission or electronic storage is 100% secure, therefore, we cannot guarantee absolute security.

COOKIES
A cookie is a piece of data stored on the user's computer tied to information about the user. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user's hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. RealUp uses cookies to enhance the performance of the site, to enable member sign in and to track unique site hits. We use both session cookies and persistent cookies in order to make it easier to use our site. We do not store in cookies any personally identifiable information you submit while on our site. Due to the functionality provided by the site, the use of cookies is required. If you reject cookies, RealUp will not perform properly.

Our website may contain links and/or advertisements to other sites. RealUp is not responsible for the privacy practices or the content of any other websites. USER CONTACT/FORWARD LISTING

However, if you contact users legitimately or use the contact features in an acceptable manner, we do not store the information for any purpose other than to send your communication.

If you choose to use our referral service to forward a listing from our site, we will ask you for your contact’s name and email address. We will automatically send your contact a one-time email inviting him or her to visit the listing. RealUp stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

When you use "Add This" to bookmark and share our products and site, you will be taken to a third party site. Please note that these third party sites’ privacy policies govern the collection and use of the information collected on those sites.

OPT-OUT/UPDATING AND ACCESSING INFORMATION
We use email as a primary communication method with users and customers. Users who do not wish to receive marketing emails including newsletters, promotional emails, or partner emails can contact us via email at contact@realup.com. Users are not able to unsubscribe from product announcements, which contain important information about service notices and responsibilities. RealUp occasionally communicates with its users via email and phone regarding issues related to their account. This type of communication is not used for marketing or promotional purposes. Requesting the deletion of certain types of user information may prevent users from accessing some web site features.

If a user wishes to correct or update personal information, such as zip code, phone, email or postal address, or no longer desires our service, they can notify us at any time by email at contact@realup.com. You may correct or update your personally identifiable information by making the change on your membership or professional profile under “Account Options” when you are signed into your RealUp account. Memberships may automatically renew unless customer cancels their membership prior to the renewal date. After a user cancellation is processed, an automated confirmation email will be sent via the customer's email account on record. If a user has a question about a cancellation, the user should contact RealUp as soon as possible.

PRIVACY CHANGES
The information you submit to us is controlled by the privacy policy in effect at the time you submit it. The privacy policy may change from time to time and an updated version of the privacy policy will always be posted on the website. When we make material changes to this privacy policy, we will notify you here, by email, or by means of a notice on our home page so that you are aware of what information we collect and how we use it.
